1. General
1.1 These general terms and conditions apply to all dental treatments and services provided by Schenkelaars Dentists.
1.2 By making an appointment and/or undergoing treatment, the patient declares to have taken note of and agrees to these general terms and conditions.
1.3 In cases not covered by these general terms and conditions, Schenkelaars Dentists will decide, taking into account applicable laws and regulations.
2. Appointments
2.1 Treatment takes place by appointment.
2.2 Schenkelaars Dentists strives to carry out appointments at the agreed time. However, an appointment may run late, for example due to emergencies or complications with another patient.
2.3 The patient must arrive on time. If the patient arrives late, the reserved treatment time may (partly) be forfeited or the appointment may need to be rescheduled.
3. Cancellation / no-show
3.1 If the patient is unable to attend, the appointment must be cancelled or rescheduled in time.
3.2 Cancellation or rescheduling is free of charge up to 24 hours before the appointment (on working days).
3.3 If the appointment is not cancelled/rescheduled in time or if the patient does not show up, Schenkelaars Dentists is entitled to charge a fee in accordance with the no-show policy:

€11.50 per 5 minutes of reserved treatment time,

with a maximum of €172.50 per appointment.
3.4 This fee is intended as compensation for the reserved time and costs incurred and is not part of regular healthcare services.
4. Fees and treatment estimates
4.1 Schenkelaars Dentists applies the fees established by the Dutch Healthcare Authority (NZa).
4.2 If the cost of the treatment is expected to be €250 or more, the patient will receive an estimate in advance (where possible).
4.3 An estimate is an approximation. The final amount may differ, for example due to necessary changes to the treatment plan or additional (technical/material) costs.
4.4 Technical and material costs (e.g. dental laboratory work) may be charged separately.
5. Payment
5.1 The patient is responsible for paying the costs of the treatment. This also applies when the patient may be eligible for reimbursement from an insurer.
5.2 Invoices must be paid within the payment term stated on the invoice.
5.3 For treatments, an advance payment may be requested or immediate payment may be required.
6. Late payment and collection costs
6.1 If payment is not made within the specified term, the patient will receive a payment reminder.
6.2 If payment is not received, Schenkelaars Dentists is entitled to hand over the claim for collection.
6.3 All legal and extrajudicial costs resulting from late payment will be charged to the patient, in accordance with statutory provisions.
6.4 In the event of outstanding payments, Schenkelaars Dentists may suspend non-urgent care until payment has been made, unless this is medically irresponsible.
7. Patient obligations
7.1 The patient must provide correct and complete information about their health, medication use, allergies and other relevant circumstances.
7.2 The patient is obliged to follow the instructions, advice and treatment agreements of the practitioner.
7.3 If the patient provides incorrect or incomplete information, Schenkelaars Dentists cannot be held liable for any damage or consequences resulting from this.
8. Treatment and duty of care
8.1 Schenkelaars Dentists performs treatment to the best of its ability and expertise and in accordance with applicable professional guidelines.
8.2 Dental treatments involve a best-efforts obligation; no guarantee can be given for a specific outcome.
8.3 Possible complications cannot always be prevented and may also depend on individual circumstances.
9. Medical records, privacy and data processing
9.1 Schenkelaars Dentists keeps a patient record in accordance with applicable legislation (WGBO).
9.2 Personal data is processed in accordance with the General Data Protection Regulation (GDPR).
9.3 The patient has the right to access and obtain a copy of their medical record in accordance with legal regulations.

10. Liability
10.1 Schenkelaars Dentists is only liable for damage resulting from an attributable failure and/or negligence, insofar as permitted by law.
10.2 The liability of Schenkelaars Dentists is limited to the amount paid out in the relevant case by the professional liability insurance, increased by the deductible (if applicable).
10.3 Schenkelaars Dentists is not liable for loss, theft or damage to patients’ property in or around the practice.
11. Complaints
11.1 If a patient has a complaint, they are requested to discuss it as soon as possible with the practitioner and/or the practice.
11.2 If this does not lead to a solution, the patient may use the practice’s complaints procedure and/or an independent external complaints or dispute resolution body, where applicable.
11.3 Submitting a complaint does not suspend the payment obligation.
12. Applicable law and disputes
12.1 Dutch law applies to all treatment agreements and these general terms and conditions.
12.2 Disputes will be submitted to the competent court in the district where Schenkelaars Dentists is established, unless mandatory law provides otherwise.
